Based on a new Washington State procurement policy, effective July 1st, 2019, Contractors may benefit by not requiring employees to agree to mandatory individual arbitration requirements.

Mandatory arbitration for employees is where a business requires its employees to agree to arbitrate legal disputes with the business versus going to court.

This procurement policy provides a maximum 5% preference to bidders for state goods and services who can show that they do not require their employees to sign arbitration clauses or collective or class action waivers.

This policy does not require terminating existing contracts or require eliminating any current stock.

This policy supports Executive Order 18-03 – Supporting Workers’ Rights to Effectively Address Workplace Violations

Applies to all state executive cabinet agencies and small cabinet agencies

Effective July 1st, 2019
